Cody Towns represents corporate and individual clients in a wide
range of complex commercial litigation throughout the country in
both specific and class action claims. His practice includes representation
in contract disputes, commercial negligence, fraud, and employment
matters including discrimination, fiduciary duty and trade secret
claims. He has extensive experience in disputes involving investment
firms under the Securities Exchange Commission and FINRA. He is
experienced in handling difficult cases under the scrutiny of national
media coverage, and has appeared on national television, in print
news media and book publication.
BACKGROUND
Mr. Towns began his legal career as a federal law clerk to the
Honorable Robin J. Cauthron, United States District Judge for the
Western District of Oklahoma. After completing his federal clerkship
he worked in the labor/employment and litigation sections of a
large law firm before joining a prestigious Dallas litigation boutique,
where he was a partner for several years before joining Rodriguez
Ghorayeb & Gersch in 2008. He has been recognized numerous
times as a “Rising Star” by Texas Monthly magazine. Mr.
Towns is a graduate, with Honors, of the University of
Oklahoma College of Law, where he was a member of the Oklahoma
Law Review and the National Trial Team. During his last year
of law school, Mr. Towns served as a law clerk to Oklahoma State
Supreme Court Justice Marian P. Opala.
TRIAL EXPERIENCE
Mr. Towns is a seasoned trial attorney with extensive courtroom
experience representing clients before courts, juries, arbitration
panels and administrative agencies throughout the country. A sample
of recent trials includes:
- Represented a large national product distributor
in a jury trial in a breach of contract case for millions of
dollars of inventory. Jury returned verdict in favor of our
client for all damages sought.
- Represented a certified financial planner in breach
of contract and breach of fiduciary duty claims brought against
him by one of the nation’s largest investment firms represented
by large Chicago law firm. A National Association of Securities
Dealers (NASD – now FINRA) arbitration panel found in favor of
our client.
- Represented an international corporation providing
civil police personnel in Iraq and Afghanistan against breach
of contract and fraud claims. At the conclusion of plaintiff’s
case, the judge directed verdict in favor of our client and required
plaintiff to pay all of our client’s court costs.
- Represented an accounting firm at trial against claims
brought in one of the largest cases ever filed by the Securities
Investor Protection Corporation.
- Represented a corporation against its former senior
employees for breach of fiduciary duty and theft of trade secret
claims. At the conclusion of trial the jury returned a verdict
in favor of our client.

WRITING AND LECTURES
Mr. Towns is a frequent writer and lecturer on topics related to
commercial and employment litigation. He has for several years
been a contributing editor to the American Bar Association Treatises: Covenants
Not-to-Compete: A State-by-State Survey; Employee Duty
of Loyalty; and Trade Secrets: A State-by-State Survey.
He was also a contributing author of the American Bar Association Antitrust
Law Model Jury Instructions. He frequently provides on-site
training seminars and lectures for his clients as well as for attorney
continuing legal education courses.
